    Formal Probate

    For assets that do not qualify for a simplified transfer process, a formal probate may be required.  The process typically takes around 18 months and requires at least two court hearings.

    Petition to Determine Succession to Primary Residence

    This petition allows for the transfer of a primary home valued up to $184,500 or $750,000—depending on the date of death—without requiring a full probate proceeding.

    Transfer real estate using an affidavit. The max value for transfer is now $61,500, depending on date of death.
